myPartner.com Privacy Policy Last Updated: December 15, 2006
1. Collection and Use of Information
myPartner.com members may take
advantage of the many services and features available online. In order to provide you
with our services, you must provide us with certain necessary information. myPartner.com
treats all of your information with the utmost care for your privacy and security. myPartner.com
does not sell, trade, or otherwise disclose customer lists or information to unaffiliated third
parties without your permission. In the event that myPartner.com should be acquired
or substantially all of its assets transferred, customer information would be considered a
transferable asset. myPartner.com will give registered members notice prior to transferring
their information, and an opportunity to opt-out of having their information transferred to
the new entity. Further, in the event myPartner.com makes a material change in the
way we collect your personal information, use your personal information, or change our email
policies, you will be notified by email or through a notice on our website. For your
information, below is a detailed list of the services available through myPartner.com,
an outline of the information collected from you to provide such services, and a description
of what we do with such information.
In order to use myPartner.com, you must first complete the registration form creating
a user name and password. During registration you are required to give contact information
(such as your email address). We use this information to contact you about the services on
our site in which you have expressed interest. You have the option to provide demographic information
(such as age, income level, gender and/or religious affiliations if any) to us; we encourage
you to submit this information so we can provide you a more personalized experience on our
site.
2. Third Party Access to Your Email Address
myPartner.com is the sole owner
of the information and does not sell or rent your email address to third parties.
3. myPartner.com Member Email Communication
myPartner.com sends all of
its members customary business communications (address confirmation, renewal notifications,
Partner Perfect Matches, e-newsletters, new feature/product and event offerings directly
related to the community) unless you have elected not to receive such communications. Further,
it is our policy to remove members from any myPartner.com mailing list to which they have
previously subscribed upon request (members will continue to receive customary business communications
from myPartner.com). You can always change your email preferences from you’re My
Home page, by selecting Account Settings. Every opt-in email communication from myPartner.com
will contain clear and obvious instructions for how the member can remove himself from that
mailing list.
4. Email "Opt-In/Out" Lists
myPartner.com has formed alliances
with several informative online companies. Such companies offer goods and services via email
to our membership. You as a member can voluntarily select to "opt-out" to not receive
information from these companies. After choosing to opt-out to not receive offers for goods
and services, you can at any time choose to "opt-in" to begin receiving these communications.
5. Sign Up
Certain features of our website, including the myPartner.com Compatibility™ system,
require the client or website user to sign up before accessing those services. During
sign-up, myPartner.com collects the following information: name, address, birth date,
and email address, along with other information about you and the type of people and relationships
you are seeking through our website (e.g., hobbies, interests, personal preferences, sexual
preferences, and personality traits). This information may then be imported into the
website programs to simplify the amount of information you will be required to enter when
using the features available on myPartner.com. In the event there is a change or
update to the services available on our website, myPartner.com may use your information
to contact you regarding such a change or update. Your demographic data is used to
show you content that may be of interest to you, and to help us display the content of our
website according to your preferences.
Also, myPartner.com uses your sign-up information to send you information about our company,
affiliates and unaffiliated third parties. You may opt out of receiving such information
by accessing you’re My Home and Account Settings.
6. Use of Membership Registration Data
Demographic and profile data is also
collected at our site. We use this data to tailor your experience at myPartner.com, showing
content that we think you might be interested in, and displaying the content according to
your preferences. myPartner.com does this in two ways. First, we analyze members’ information
in aggregate - that is, we collect information about thousands of site visits and analyze
it as a whole. This kind of study involves looking for trends among many visitors to myPartner.com,
rather than analyzing information about any individual member. Examples include researching
which parts of the site are accessed most frequently, or determining which products are most
attractive to our users. Second, we may use information gathered during your visit to help
customize our communications with you at an individual level.
7. Online Member Surveys
myPartner.com may periodically conduct individual
voluntary member surveys. We encourage our members to participate in these surveys because
they provide us with important information that helps us to improve the types of services
we offer, and how we provide them to you. The responses we collect in online surveys may
or may not be anonymous to us; each survey will disclose whether or not it is anonymous.
In the end, we hope to tailor our communications with you and site layout to fit your needs
--- so that you receive more of what you want from us and less of what you don't want.
8. Service Providers
We use third parties to provide some products or services.
Information is shared as necessary for the third party to provide that service. For example,
we use an outside company to process your credit card information. These third parties are
not permitted to use your personal information for any purpose unrelated to providing that
product or service.
9. Instant Messaging and Other Site Features
If you use myPartner.com’s
instant messaging system or upload a photo function, or use bulletin boards or chat rooms
on this site (if those features are available on the site), you should be aware that any
personally identifiable information you submit there can be read, collected, or used by other
users of these forums, and could be used to send you unsolicited messages. We are not responsible
for the personally identifiable information you choose to submit in these forums.
If you choose to use our referral service to tell a friend about our site, we will ask you
for your friend’s name and email address. We will automatically send your friend an
email inviting him to visit the site. myPartner.com uses this information for the sole
purpose of sending email and tracking the success of our referral program. Your friend may
contact us at the listed contact information to request that we remove his information from
our database.
10. Making Changes to Your Personal Information
Your myPartner.com account
information is password protected so that only you have access to this personal information. You
may update this information as necessary by clicking on the appropriate edit option in the
My Profile section, which allows you to access and edit your account information, including
your opt-in/opt-out choices.
11. Protecting Your Personal Information
myPartner.com strongly recommends that you
do not divulge your password to anyone. myPartner.com will never ask you for your
password in an unsolicited phone call or email. Also, remember to log out of your myPartner.com
account and close your browser window when you have finished your session. This will
help to ensure that others cannot access your personal information and correspondence if
you share a computer with someone else or are using a computer in a public place.
12. Orders
If you purchase a product or service from us, we request certain personally
identifiable information from you on our order form. You must provide contact information
(such as name, email, and shipping address) and financial information (such as credit card
number, expiration date). We use this information for billing purposes and to fill your orders.
If myPartner.com has trouble processing an order, we will use this information to contact
you.
When you initially provide your financial information on myPartner.com, we use that
data to bill you for products and services you use, as well as check your qualifications. If
you choose to participate in any discount, rebate or other incentive programs, your financial
information disclosure enables your participation as well. By making a purchase on
the website, or accessing any financial transaction or activity on the website, you automatically
consent to allowing us to provide your financial information to our service providers, as
well as your credit card issuer for their assistance in processing your transaction. Your
financial activity on the website also allows us to contact any other third parties we determine
as necessary to process your transactions. These third parties may include banking
facilities and/or credit card institutions used to process and verify your financial transaction. It
is also important to note that occasionally separate third parties offer products and services
on the website, and/or administer programs offered on the website. In those cases,
if you purchase, register or make reservations for these products or services offered by
the third parties, or participate in programs that are administered by third parties, any
financial information you submit is passed by us through the website to those third parties
with your full consent, implied by your consent and participation.
13. Co-branded Services
Additionally, if you submit information on a Co-Branded page,
or you accessed the page on which you submitted information by clicking a link on a Co-Branded
page, then we may share your financial information with that associated Co-Branded company. Any
of these various third parties mentioned above (including Co-Branded companies) may be authorized
to use your financial information in accordance with our contractual arrangements with such
third parties. The usage of this financial information must also be in accordance with
their privacy policies, over which myPartner.com has no control. Because of this,
you agree that myPartner.com is not responsible or liable for any of their actions or
omissions. Additionally, you agree that myPartner.com may use and disclose all such
information so submitted to such third parties in the same manner in which we are entitled
to use and disclose any other information that you submit to us.
14. Other Co-Branded Services
These other "Co-Branded" websites are managed
by the companies providing the services. Any information you provide on these websites
is governed by each website's own privacy policy, or the privacy policy of the company providing
the services. Because myPartner.com is not responsible for the privacy practices
of these companies, the content of their websites, or the services offered through these
Co-Branded websites, we recommend that you review the privacy policies of these websites
for information about their respective privacy practices. This section will be updated
periodically as myPartner.com expands to offer exciting new services through the use of
co-branded websites.
15. Sweepstakes and Contests
Occasionally, myPartner.com may
offer users of myPartner.com the opportunity to enter a sweepstakes or other such contests. In
order to enter the sweepstakes, users will be asked to provide their name and contact information
through an online or mail-in registration process. This information may be used by
myPartner.com to initiate communication with the registrant. Moreover, the information
may be shared with a third-party sweepstakes administrator only for purpose of selecting
winners and notifying winners about the prizes they have won. myPartner.com will
not enter the user in a sweepstakes or contest without his or her consent. For more
information, please see the Official Sweepstakes Rules in place for current contests.
16. The Security of Your Information
myPartner.com works diligently to protect
the security of your personal information, including credit card information, during transmission
by using Secure Sockets Layer (SSL) software, which encrypts information you input. Your
data is kept in a highly secure environment protected from access by unauthorized parties.
It is important for you to protect against unauthorized access to your password and to your
computer by ensuring you logoff when finished visiting myPartner.com using a shared computer
(such as computers from work, cyber-cafes or libraries).
17. Legal Obligations
myPartner.com may be required to give information to legal
authorities and other parties if they have the proper authorization such as a search warrant
or court order. Short of that, the only people authorized to view your contact or billing
information are authorized employees at myPartner.com, acting within the scope of their
duties.
myPartner.com will not disclose your personally identifiable information to non-affiliated
third parties without your permission unless we need to do so in order to comply with applicable
law, a subpoena, or other legal process or to protect the personal safety of our users or
the public.
18. Cookies
Cookies are small pieces of information that are stored in a browser-related
file on your computer's hard drive when you use our Web site. myPartner.com uses cookies
to improve the member experience, like allowing the member to login without typing the registered
email address or registration number and password. We also use them to deliver information
and fresh content specific to your interests. Cookies are widely used on most major Web sites
and ARE NOT tied to a user’s personal information.
19. Third-Party Cookies and Pixel GIFs
We may use third-party advertising companies
to serve ads on our behalf. These companies may employ cookies and action tags (also known
as single pixel GIFs or Web beacons) to measure advertising effectiveness. Our understanding
is that information that these third parties collect via cookies and action tags is anonymous
and we do not enable third party advertising companies to have access to any of the personal
information you have provided to us.
20. Limited Access to Information
myPartner.com guards
your personal information carefully. The
individually identifiable information that you provide will be used by myPartner.com and
its affiliated companies to provide you with information about products and services available
to you through myPartner.com, its affiliated companies, and/or non-affiliated third parties. myPartner.com
will not disclose individually identifiable information to non-affiliated third parties without
your permission. If you do not wish to have information shared with our affiliate,
MyMeetMarket, you must opt-out under you’re My Home and Account Settings. You may opt-out
of sharing your personal information with affiliated companies by sending an email to optout@myPartner.com.
Upon your request, myPartner.com will share your information with its affiliated representatives. For
example, if you need assistance in completing your profile, you may request that an affiliated
relationship consultant contact you to review your profile or provide other assistance. Upon
such a request, myPartner.com will forward your name, phone number and other information
you authorize to a relationship consultant. myPartner.com will not, however, forward
any information without your request to do so.
myPartner.com may share aggregate information
collected through myPartner.com with non-affiliated third parties. Aggregate information
does not identify you, but rather is based upon a summary of information about all users. For
example, we may tell an advertiser that 100,000 users clicked on a specific link, and out
of the 100,000 users, 85% were from Texas. This aggregate information assists advertisers
in determining how they can best promote their products. We will not tell our advertisers
who it was that saw or clicked on their advertisements.
21. Browser Monitor
myPartner.com may employ a browser monitor within Web
pages on our site (including your My Home page) in order to optimize your user experience.
Browser monitors help identify browser status and the client-side metrics relating to page
loading. myPartner.com constantly seeks ways to improve page load times for our members
and may ultimately use these metrics for such purposes. Any such browser monitor will only
be active while the user is active on myPartner.com site. For your protection, any such
browser monitor will not require an executable (*.exe) application.
22. IP Address and Log Files
Like most Internet sites, we use your IP address
and standard log files to help diagnose problems with our server, and to administer our Web
site. Your IP address and referring URLs also are used to gather broad demographic information.
This information is distributed to current and potential advertisers, but only in aggregate
form. It does not contain information that identifies individual members.
23. Advertisers
Users of myPartner.com should note that when you are on myPartner.com,
you may be directed to other websites that are beyond our control. For example, if
you click on a banner advertisement, the click may take you off the myPartner.com website. Banner
advertisers on myPartner.com do not have access to your personally identifiable information
so long as you remain on our website. However, these other websites may independently
collect data, solicit personal information or send their own cookies to you in accordance
with their own policies. myPartner.com, or its affiliates, is not responsible for
the privacy practices or the content of such websites. myPartner.com strongly encourages
you to review the policies of any such third parties to whom you may give personally identifiable
information. myPartner.com may use third-party advertising companies to serve ads
on our behalf. In order to make sure that the advertising you may see is relevant to
you, these companies may employ cookies and action tags, also known as single-pixel gifs
or Web beacons.
24. Information Shared In Aggregate
myPartner.com may share aggregate information collected through myPartner.com with non-affiliated third parties. Aggregate information does not identify you, but rather is based upon a summary of information about all users. For example, we may tell an advertiser that 100,000 users clicked on a specific link, and out of the 100,000 users, 85% were from Texas. This aggregate information assists advertisers in determining how they can best promote their products. We will not tell our advertisers who it was that saw or clicked on their advertisements.
25. Third-Party Links
myPartner.com contains non-advertising
links to a variety of third party sites to enhance the member experience. myPartner.com
has no control of either the content or privacy policies of such sites, nor should such links
be considered an endorsement of these sites except where otherwise noted. myPartner.com
has no control over its advertisers' privacy policies, and encourages users to review such
policies prior to submitting any personal information to them.
26. Children/Minors
Protecting the privacy of minors is especially important
to myPartner.com. For that reason, we never collect or maintain information at our Web
site from those we actually know are under 18, and no part of our Web site should be used
by those under 18. If we learn that anyone under 18 is using the site, that person will be
blocked from accessing the site.
27. Updates to our Information Practices
From time to time, we make changes
to our information practices or alter the functionality of our Web site. We always update
this statement accordingly, so we encourage you to periodically review this page for the
latest information on privacy practices at myPartner.com. If we make material changes
to this policy, we will notify you in this Privacy Policy, by email, or by means of a notice
on our home page.
28. Abuse of Terms of Use
We have the right to share your name and contact
information with our attorneys and law enforcement officials, if needed, in the event we
believe you have breached our Terms of Use.
Please direct questions regarding our Privacy Policy and information practices to customercare@myPartner.com.
